Agreement to Terms
This End User License Agreement ("EULA") is a legal agreement between you (the user) and ONLYWINS TRACKER LTD ("Licensor") for the Onlywins Tracker software application ("the App"), including all associated documentation and digital content.
By installing, copying, or otherwise using the App, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the App.
License Grant
ONLYWINS TRACKER LTD grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the App on Apple iOS devices that you own or control.
- Use the App for personal, non-commercial purposes in accordance with this EULA.
This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise exploit the App commercially.
License Restrictions
You may not:
- Copy, modify, or create derivative works of the App.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Remove, alter, or obscure any proprietary notices, labels, or branding within the App.
- Use the App for any commercial purpose without prior written authorization from ONLYWINS TRACKER LTD.
- Use automated systems, bots, or scripts to interact with the App.
- Use the App in any manner that violates applicable law or regulation.
Intellectual Property
The App is licensed, not sold. ONLYWINS TRACKER LTD retains all right, title, and interest in and to the App, including all intellectual property rights. This includes all software code, design, graphics, copy, category system, recipe library, and branding.
You retain ownership of your personal data — including all tracker entries, configurations, and progress history — stored locally on your device.
User Data and Privacy
Your use of the App is also governed by our Privacy Policy. Onlywins Tracker is built on a privacy-first approach: all data is stored locally on your device and is never transmitted to us or any third party.
We do not collect account information, analytics, or crash data. No SDKs or services that transmit user data are included in the App.
No Subscriptions or In-App Purchases
Onlywins Tracker is currently offered as a free application with no subscription fees, in-app purchases, or paid upgrades. All features described are available without payment.
Warranty Disclaimer
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONLYWINS TRACKER LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of security vulnerabilities. Onlywins Tracker does not guarantee specific results, outcomes, or progress.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONLYWINS TRACKER LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGES.
Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the App and delete all copies from your devices.
Updates and Modifications
ONLYWINS TRACKER LTD may provide updates, patches, or new versions of the App. These updates may be downloaded and installed automatically. We reserve the right to modify this EULA at any time. Continued use of the App after changes constitutes acceptance of the modified EULA.
Apple App Store Terms
The App is distributed via the Apple App Store. Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between this EULA and Apple's terms, Apple's terms will govern with respect to the distribution platform.
Governing Law
This EULA shall be governed by and construed in accordance with applicable law, without regard to its conflict-of-law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration or in the courts of competent jurisdiction.
